Can the proceedings of the POSH Committee be quashed if the inquiry is not completed within 90 days? On 11 January 2023, the Delhi High Court made a crucial observation that all POSH Committee (IC) members need to take note of: 1. Even if the Committee fails to complete the inquiry within the 90 day timeline that is laid down under Section 11(4) of the POSH Act, 2013, the inquiry proceedings will not be quashed, and 2. The 90-day timeline “cannot be made mandatory.” This change reduced the chances of dropping cases in scenarios where the investigation was taking more than 90 days. #POSH #PoshAct #workplaceharassment #sexualharassment

The Karnataka government has introduced the Karnataka Compulsory Gratuity Insurance Rules, 2024, effective January 10, 2024, bringing in a significant shift in gratuity regulations. Here's why employers should act promptly and register under this scheme: 1. Timeline for obtaining Mandatory Insurance: New employers need to obtain valid insurance within 30 days from the applicability of the Payment of Gratuity Act, 1972. Existing establishments have a 60-day window from January 10, 2024, to secure valid insurance from the Life Insurance Corporation of India or any other compliant insurance company. 2. Renewal and Premium: Employers must ensure timely payment of premiums to the insurance company and renew policies before lapses. A crucial reminder: notify the controlling authority of the renewal within 15 days. 3. Purpose of insurance: Controlling authorities can recover gratuity amounts directly from the insurance company. This streamlines the process for timely payment to employees. 4. Registration of Establishment: Employers should submit applications in Form-I for registration with controlling authorities within 30 days of obtaining insurance, providing employee details in Form-III. Any changes should be promptly communicated to the authority. 5. Approved Gratuity Fund: Employers with an existing approved gratuity fund or those employing 500 or more persons can continue or adopt such arrangements by submitting an application in Form II. This ensures comprehensive coverage for all employees. 6. Gratuity Trust related aspects: Employers may establish a gratuity trust with 5 trustees, including employer and employee representatives, managed privately, by an insurance company, or jointly. Contributions are contributory from the employer and non-contributory for employees. Compliance with tax and accounting standards is crucial. This initiative aims to streamline gratuity processes, ensuring timely and secure benefits for employees.
